Warranty conditions

Thank you for purchasing a STRONG Energy product. This Limited Consumer Warranty Statement (hereinafter referred to as “Warranty”), as described below, applies to the residential application of energy storage inverters, battery storage systems and related accessories (hereinafter referred to as “Product”) supplied by STRONG Energy or STRONG Energy authorized institutions (hereinafter referred to as “STRONG Energy”) to the end user (hereinafter referred to as “User”) who places the Product into service for the first time, in the manner authorized by STRONG Energy.

Prerequisites

The warranty period shall commence on the earlier of the following dates:

1) Date of purchase on a valid purchase invoice presented by the user.
2) Date on which the first installation of the warranted product is completed (if no proof of purchase is available)

This is a limited warranty that only covers the repair or replacement of a defective product. STRONG Energy will repair or replace the product if the product is defective and a complaint is made during the warranty period. This warranty does not apply to accessories and tool kits that are not listed in the table above. If the product needs to be replaced, the remaining warranty period will be transferred to the replacement device, i.e. the warranty period of the original device will continue. In this case, you will not receive a new warranty card and this replacement will be registered by STRONG Energy. If the remaining warranty period is less than 6 months, you will automatically receive a 6-month warranty period for the replacement device.
For the repair or replacement service, the products/parts can be used as new or refurbished condition with the same or higher performance than defective products.

If the product is no longer on the market, STRONG Energy can replace it with another product of similar function and performance.

The statutory warranty obligations of the purchaser, which may not be lawfully excluded or limited, are not affected by this STRONG Energy guarantee. Furthermore, national statutory rights remain unaffected by the provisions of this STRONG Energy Guarantee.

1. exclusion of warranty

1) The above warranty period has already expired.
2) Product damage and defects caused by improper use, misuse or incorrect operation by the user.
3) Changes have been made or repairs attempted by persons not authorized by STRONG Energy, or the model number, nameplate or serial number of the product has been altered, erased or is no longer recognizable, or the tamper-resistant logo has been arbitrarily damaged.
4) The product was incorrectly installed or commissioned, taking into account the user manual, the installation instructions and the maintenance instructions.
5) You or another user have violated the safety regulations (VDE standards or equivalent)
6) The product was stored improperly and damaged during storage by the dealer or the end user
7) Product damage and defects caused by improper packaging, transportation, storage, installation, wiring and use with faulty or incompatible devices by the user.
8) Product damage and defects caused by negligence, accidents, force majeure events, including but not limited to external influences, unusual physical force, force of nature, lightning, flood, fire, extreme cold weather, etc. or other events beyond STRONG Energy’s reasonable control;
9) Product damage and defects caused by external influences, including unusual physical or electrical stresses (power failure, inrush current, lightning, flooding, fire, accidental breakage, etc.);
10) The damage is only cosmetic and has no effect on the function of the device.
11) Product damage and defects arise due to the renewal of national or regional laws or regulations.
12) Product damage and defects caused intentionally by the user.
13) The product is used for applications other than those specified.
14) The product is installed in a country in which the product is not intended to be sold. The products may currently only be put into operation in Austria and Germany.
15) A product defect is not reported to STRONG Energy within 4 weeks of its appearance.

2. error handling

(1) If the product fails, the user shall cooperate with STRONG Energy to obtain the information about the usage of faulty equipment, including but not limited to: serial number of the faulty equipment, working temperature, usage mode, manufacturer/model/specification of the connected inverter, power consumption information of the equipment, system configuration information, fault phenomena, operation procedures, battery operation logs, purchase date, etc.

(2) After both parties have mutually agreed that the product is covered by the warranty, the defective components can be replaced by spare parts. The replacement of spare parts may only be carried out by STRONG Energy authorized employees or partners.

(3) If the two parties disagree on whether the defective device meets the warranty conditions, the product may be tested jointly in the manner approved by both parties, or the product shall be submitted to the independent testing institutions recognized by both parties. Both parties can give reasonable opinions on the test methods, basis and conclusions. The test fee must initially be paid by the user. If the test result proves that the product meets the warranty conditions, STRONG Energy will pay the transportation fee and test fee incurred in full to the user and assume responsibility for the warranty for defective equipment.

(4) If the product needs to be transported from one place to another, the following transportation requirements must be met:
a. If the product is transported separately, the individual products should be transported with the original packaging material. If long-distance transportation such as sea transport is required, additional packaging measures should be taken to ensure the safety of the transport. The product stack during transportation does not exceed the originally designed layers.

b. If the product is not transported with the original packaging material, the user must fully consider the risks of vibrations, falls and collisions during the transportation process and take appropriate product protection measures.

3. outside the warranty

With respect to out-of-warranty service for the Products, STRONG Energy may provide the User with specified service upon written request to STRONG Energy’s authorized service representative, and all costs and expenses, including but not limited to the cost of materials, parts or labor, shall be borne by the User.

In the event that the user notifies STRONG Energy in writing that service is requested outside of the warranty, the user must provide a detailed description of the defects so that the authorized STRONG Energy service partner can determine whether or not the defect can be repaired. For the avoidance of doubt, STRONG Energy shall in no event be liable for service outside the warranty.

4. claim

Claims can be made to the authorized dealer from whom the product was purchased or directly to STRONG Energy. You must inform STRONG Energy of a complaint within 4 weeks of discovering a defect.

To make a claim under this warranty, you must provide us with the following information and documentation about the defective inverter:

1) Product model and serial number
2) A copy of the valid purchase invoice
3) Error descriptions and error IDs (if applicable)
4) Details of the end user and/or claimant
5) Detailed information about the entire system (module, PV system plan, installation date, etc.)
6) Documentation of previous complaints/exchanges (if applicable)

Assignment and/or transfer of these rights to persons other than an authorized guarantor is not permitted. The person entitled to the guarantee is exclusively the purchaser of the products or a third party named by him.

STRONG Energy may contact the user to obtain further information about a defect. STRONG Energy may require the user to carry out a detailed analysis of the product in order to provide evidence for the claim. The final review of the claim will be carried out by STRONG Energy. If the user disputes STRONG Energy’s verification of the claim, the product must be evaluated by a government certified testing laboratory or certified third party testing company. The user is responsible for the cost of the third party evaluation service fee (unless the claim is found to be valid, in which case STRONG Energy is responsible for the testing costs).

If the product is defective during the STRONG Energy warranty period, it will be:
– repaired by STRONG Energy, or
– repaired on site, or
– replaced by a refurbished product that contains all firmware updates

Defective products and components should be returned to STRONG Energy, they must be packed for transportation in their original packaging or equivalent. STRONG Energy reserves the right to arrange warranty service for users and to engage third parties to perform warranty services.

5 Applicable law

The guarantee is subject to German law to the exclusion of the UN Convention on Contracts for the International Sale of Goods, in addition to other rights and remedies to which a consumer is legally entitled.

6. disclaimer

Disclaimer for the firmware
STRONG Energy provides firmware updates for products purchased from STRONG Energy at regular intervals at its own discretion. Such firmware updates are provided to the warranty claimant “as is” and normally at no additional cost. STRONG Energy assumes no obligation to reimburse the costs incurred or to provide maintenance, support, further updates or configuration changes. Unless STRONG Energy can be proven to have acted with willful intent or gross negligence, STRONG Energy shall not be liable for any direct, indirect, incidental or consequential damages, including loss of production, lost profits or other additional expenses arising out of or in connection with the STRONG Energy firmware update, regardless of whether it is performed remotely or manually, even if the user has been advised of the possibility of such damages. The buyer’s statutory warranty obligations, which may not be lawfully excluded or limited, are not affected by the exclusion of liability for the firmware.

To the extent permitted by law, STRONG Energy shall not be liable for any loss, damage or corruption of data, loss of use of products and functionality, loss of business or contracts, loss of profits, loss of revenue or anticipated savings, increased costs or expenses or for indirect, consequential or special or punitive loss or damage. To the extent permitted by law, STRONG Energy’s liability is limited to the purchase value of the product. The above restrictions do not apply in the event of gross negligence or willful misconduct on the part of STRONG Energy or in the event of death or personal injury that can be proven to be due to STRONG Energy’s negligence.
